In New York, there was a recent case about an individual who got cited for vaping in public. He was on a New York subway platform when the citation took place. This person who was vaping did not think that this citation was justified. He decided to take matters into his own hands and fight it. The part that surprised many was that the judge agreed with the individual vaping.
The judge ended up breaking down words of the New York law. According to the law, smoking is “the burning of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco.” Reading this definition carefully, it is clear that vaporizers do not count as what the state defines smoking as.
